Seminar Description
There's always been a spectrum of different types of uses of copyrighted works. At one extreme there is clear infringing activity; at the other extreme, clear non-infringing activity. But there's a wide range of activities between these extremes that may or may not implicate one or more of a copyright owner's exclusive rights. Many of these activities may be covered by the fair use defense, but what's considered a "fair use" is not always clear. Beyond fair uses there are "tolerated uses," which are likely infringing but which the copyright owner tolerates for one reason or another. New technologies and social media, not to mention the precarious ethical and moral standards of users, makes these very grey areas even more grey. This seminar will explore these different types of uses and the different types of considerations for copyright owners and users.

This program is intended for anyone involved in day-to-day copyright compliance issues and will be especially helpful for librarians, information professionals, and others who oversee or are affected by the use of content in business environments.

- What technologies are available to end users that may help facilitate copyright uses that fall into a grey area of the law?
- Is there a threshold at which a copyright holder should determine whether to pursue a copyright use in the court?
- What "uses" in the corporate setting may be considered "fair" uses?
